Supreme Court forces SERNAPESCA to report on health status of farmed salmon

The National Fisheries and Aquaculture Service (SERNAPESCA) will have to report on the health situation of salmon production in Magallanes and in the regions of Los Lagos, Los Ríos and Aysén, in particular on the use of drugs and diseases treated in some farming centers of two companies that operate in these areas.

The Supreme Court last week accepted a complaint resource from the Council for Transparency (CPLT), so SERNAPESCA must now submit a history of pesticide use and the presence of two infectious diseases in the salmon production centers of two companies with operations in several southern regions, which had opposed disseminating them.

The ruling leaves without effect the judgment of the Court of Appeals of Puerto Montt that allowed the private companies to keep confidential information of their centers.

The companies that presented such an illegality remedy were Salmones Multiexport S.A. and Multiexport Pacific Farms in response to a request for access to information about salmon centers operated by both companies, alleging that their economic or commercial rights are affected.

The requirement was made to companies that operate in different regions of the south of the country, but the two mentioned decided to take the case to court in order to keep in reserve information of certain periods on pesticide use - Deltramine and / or Cypermethrin - in farming centers in Los Lagos, from Aysén, and Los Ríos, and the lists of fish farms or production centers that reported the presence of two pathologies that attack the species in the same regions and Magallanes. Specifically, the application points to background knowledge about the presence of flavobacteriosis and Rickettsial salmon syndrome (SRS) in any of the production stages.
